A lawyer representing ousted Toombul business owners believes there’s potentially some grounds on which they can pursue recourse. 

Property developer Mirvac has brought redevelopment plans forward after February’s floods caused substantial damage to Toombul Shopping Centre.

It meant the leases of all businesses at the Nundah centre were cancelled immediately with no compensation, leaving many owners massively in debt and with no income.

Solicitor Brian Noble attended a meeting with evicted tenants yesterday and is offering pro bono services for those looking to pursue legal action against Mirvac.

He told Neil Breen it’s a bit of a process to sift through tenants’ leases and notices but he’s considering whether they have rights under the Retail Shop Leases Act and Australian Consumer Law.

“One of the issues they’ve got is Mirvac’s not letting them remove their properties from their tenancies, which doesn’t sound right,” he said.

“There’s quite a few legal issues to address.

“I don’t think it will [go away] from the vibe of the meeting yesterday, people want to get in there and have a go at Mirvac and put the pressure on them.”
