A gym owner is taking on property giant Mirvac after the abrupt closure of Toombul Shopping Centre left him with $1.3 million in debt. 

Function Well Gym had been open for just 10 months when the lower floor of the centre flooded in February this year.

Owner Darren Bain says despite his business suffering no damage in the flood, he’s being turfed along with other businesses in the building.

“My frustration with this is Mirvac has the insurance and then, I know they definitely have a master plan to redevelop the site,” he told Neil Breen.

“They’ll bring that forward, so they’re going to get the win of the redevelopment, plus they’re getting their insurance and we get left with nothing but huge debt.

“I’m chasing them up and still have no indication on when I’ll get my bank guarantee back.”

Mr Bain told Neil Breen he feels he has no choice but to get lawyers involved in the dispute.

“You’re taking on Mirvac,” he said. “How am I going to win against Mirvac?”
