CMC and the Gold Coast investigation

We need to have confidence that our politicians and police are beyond corruption.

These allegations about police on the Gold Coast are shocking.   That’s why the CMC has to be right onto the issue.   Quickly.   We need to know that any allegations against police will be investigated quickly and thoroughly.

I don’t have confidence in the CMC and its systems in Queensland.   Police Commissioner Bob Atkinson today said the CMC had been looking at concerns of the possibility of police being involved in improper corruption activity on the Gold Coast for 10 years.

I wonder why these investigations take so long.   Last September, two police were allegedly involved in the infamous “nudie run”.   They were special operations police at a mate’s buck’s day.   They are normally on call, so they don’t drink much.   Obviously they did get stuck into it on that day.

Those allegations are simple.   Today we learn that the investigation will take 9 months.   It’s taken 5 months so far.   9 months to look at a moment of drunken madness.   The two police are stood down from their operational jobs.   9 months for a simple, disciplinary investigation?     Why?

Then we come to a murder.   The late Omega Ruston was shot and killed on Australia Day last year.   The CMC took over part of the investigation last year because of a belief that the people who were wanted in the murder wouldn’t co-operate with police, they might leave the country or they might intimidate other witnesses.

We only know about the CMC’s involvement because Paul Younan, Jason Khalil, Toni Elbayay and Marian Kazzi didn’t want to co-operate with the CMC either.   They went to the Queensland Supreme Court.   They lost.   The Supreme Court of Queensland heard that Omega Ruston was shot as a result of a road rage incident involving a vehicle with 3 Lebanese people inside.

Younan, Khalil, Elbayay and Kazzi lost their legal bid to avoid questioning in August last year.   I wrote to the CMC on 20 November last year, enquiring about progress in the investigation.   I received this reply from the CMC media spokesperson.

“Thanks for your query. Unfortunately, the CMC does not publicly discuss any matters it may be involved in.”

Well the CMC may not comment about persons of interest wanted in connection with a murder, but they are more forthcoming in commenting about the police they are investigating.

"The evidence gathered (Sunday) will be assessed as part of an ongoing police misconduct investigation that ... was being progressed by the CMC in a covert manner,'' Director of CMC Misconduct Investigations Russell Pearce said.

"A police officer has been suspended on the basis of evidence discovered on Sunday morning.''

It’s essential that we have confidence in our police, politicians and those who investigate allegations against them.   Having now made these allegations public and confirmed that there is a police misconduct investigation on the Gold Coast, the CMC needs to get its act together.

We have a right to know now.

    The CMC have someone inside it that performs the following function...when they are notified of police corruption, Ms X [ in 2003 it was a women - they are more easily manipulated ]passes everything to police ahead of everyone so that Mr Y in the police, can set up a process of deniability and tactics to paper shuffle the incident to death, notify the named people so they can take steps to nullify it as much as possible.

  • The CMC will now be given more Police so Police can investigate its own Police we were told yesterday. This is a farce and a sham and we all know it. We also know how bad things are when their mission statement is no longer respected by Police and they use fear and violence against innocent victims of crime in the people’s house (Parliament).     The Police Mission statement: To serve the people in Queensland by protecting life and property, preserving peace and safety, preventing crime and upholding the law in a manner which has regard for the public good and the rights of the individual.

    I contacted Aiden McLindon after his recent public claim he wants to be the catalyst for change within the LNP. I am hoping he just might be the next Bill Gunn and raise my documented and corroborated judicial corruption allegations and the failure of the CMC to investigate them on the floor of Parliament, because my own MP, John Mickel the Speaker of Parliament has repeatedly denied us electoral representation. I have received no response from Mr McLindon yet.

    Doctors are now obliged to report medical misconduct. When will jurists be required to demonstrate the same probity and integrity and report judicial misconduct?

  • I agree with you Gayle and also have no confidence. The courts, the CMC, PCMC and other Commissions like the Police Commission, Ombudsman etc are all highly politicised and politically appointed.

    Instead of transparency and accountability I see only nepotism and cronyism, which has no place in any true democracy. It is high time the judiciary and crucial decision makers are all democratically elected because we deserve nothing less than professional, competent, impartial and truly independent judges and decision makers.

    Only the Pope gets a lifetime job guarantee, no one else should. And I am still waiting for the Police Minister and Police Commissioner to act on my complaint as documented on the Michael Smith 4BC corruption blog and acknowledge me as an Australian citizen with inalienable human rights to access to an effective remedy and access to public service in my very own country on equal terms.

    Under the rule of law no one is above the law and no one is beneath the law. We are all equal in front of the law and in front of the courts. But that is unfortunately no longer the case under the Bligh Labor government and there is no democracy without a strong and effective opposition.

  • Smithy how on earth can we have confidence in our Politicians not being corrupt when every time they open their mouths we hear lie after lie.
    Who appoints the CMC?
    When there are judges that are appointed by Politicians that let criminals walk free.
    When the laws are skewed in favour of the crims against the victims why are we surprised that police throw up their hands and say if you can't beat them join them.
