Granite Transformations Kitchen Makeover Promotion
Fairfax Radio Network
These contest rules apply to the Granite Transformations Kitchen Makeover Promotion.
1. THE PROMOTER:
This competition is promoted by the Fairfax Radio Network.
2. WHO MAY ENTER
The competition is not open to:
(i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition; or
(ii) the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household).
(iii) They are discovered to have used or attempted to use any more than one name on order to qualify to win any contest run by the Promoter except in the case of a legal change of name.
(iv) a person who has won a prize or prizes in any Fairfax Radio Network competition within a forty-two (42) day period
(v) Only one (1) winner per family/household per contest.
All contestants acknowledge that the Promoter can rely on Clause 2 and even if the Promoter only learns of a person's ineligibility after the Promoter has appeared to award the prize to the ineligible person. Return of the prize or payment of its value to the Promoter can be required by the Promoter if this occurs.
3. GENERAL PRIZE NOTES
All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variation in item values. Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner.
Prizes are non-transferable and may not be redeemed for cash. If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of like or equal value.
Any tax payable as a result of a prize being awarded or received will be the winner's responsibility.
In relation to prizes involving participation in any activity -
a) The Promoter and its employees and agents will be fully released from and indemnified by winner in respect of any claim for accident, injury, property damage or loss of life in connection with winners' participation in the prize.
b) Winner may, at the option of station as precondition to entitlement to prize.
4. PRIZE DELIVERY
The winner will be issued a certificate of redemption for the kitchen makeover from Granite Transformations Australia. This prize certificate must be collected from the radio station reception within (30) days of notifying the winner that he or she has won the prize or the prize may be forfeited. Alternatively, at the discretion of the Promoter, the prize may be posted to winners at the cost of the Promoter. Any loss of prizes by Australia Post is not the responsibility of the promoter. It is up to the discretion of the promoter to replace the prize.
Upon request by the Promoter a copy of the general contest rules and/or a signed receipt and acknowledgement must be signed and endorsed by any winner to indicate his/her understanding and acceptance of these terms.
Prizes will only be awarded following winner validation and verification.
The judge's decision is final and no correspondence will be entered into.
5. PUBLICITY
Acceptance of a prize constitutes permission for the Promoter to use winner's name, suburb of residence, recording of winner's voice and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
6. EXCLUSION OF LIABILITY
The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise delivery details provided by an entrant. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes.
To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained to personal property and including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner(s) and, where applicable, to any persons accompanying the winners. A person who enters a competition releases from and indemnifies the Promoter from and against all liability, cost, loss or expense arising out of acceptance of any prize or participation in any competition including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
A winner (or his or her guests/parent/guardian as appropriate) may be required to sign and return any liability release provided by the Promoter and/or its contractors as a condition of the major prize being awarded. Failure to return the signed releases and indemnities will result in the entitlement to the prize being forfeited and a selection of another winner.
7. OWNERSHIP OF ENTRIES
All entries (whether in written, audio or visual form, or a combination of those) become and remain the property of the Promoter (subject to the limits contained in the Privacy Statement). Including photographs.
8. DISQUALIFICATION
The Promoter is not responsible for lost, interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
The Promoter assumes no responsibility for any error, defect, delay, theft or unauthorized access to or alternation of entries. Subject to any written directions given under the applicable law, if for any reason, the competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorized intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, or proper conduct of the competition, then the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this competition. The Promoter reserves the right, in its sole discretion, to disqualify any individual for:
a) Tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the promotion;
b) Tampering with the operation of the competition or web site;
c) Acting in violation of these terms and conditions;
d) Acting in an unsportsmanlike or disruptive manner; or
If an entrant selected as winner is found to be in breach of paragraphs 3 or 4 of these conditions of entry, a new winner may be selected and, in the event that the entrant in breach has been awarded a prize, the entrant may be required to return the prize or reimburse the value of the prize to the Promoter.
9. PRIVACY:
Entrants acknowledge and consent that the collection of personal information will be in accordance with the Fairfax Radio Network Privacy Policy.
10. PARTICIPATION:
Participation in the competition constitutes the entrant's unconditional agreement to and acceptance of these Competition Entry Rules. The Entrant is responsible for insuring his or her familiarity with the Competition Entry Rules at the time of participation. The Promoter's decision not to enforce a specific restriction does not constitute a waiver of that restriction or of the Competition Entry Rules generally.
Where the Promoter has special contest conditions or rules in relation to a particular contest, then they will prevail to the extent of any inconsistency between those special conditions and these General Competition Entry Rules.
11. METHOD OF ENTRY
Listeners will go to the Granite Transformations Kitchen Makeover Competition page of their talk radio station website in Sydney (2UE.com.au), Melbourne (3AW.com.au), Brisbane (4BC.com.au) or Perth (6PR.com.au), and register as per the entry details on the competition. Another method of entry if via the post in writing All entries must have a photo accompanied as stated to be part of the competition.
12. COMPETITION DURATION
Registrations will be taken online and via postal entry during following times in each market: (AEST)
2UE Sydney - from 8.30am Monday 16 February 2009 until 5.00pm Sunday 8 March 2009
3AW Melbourne - from 8.30am Monday 16 February 2009 until 5.00pm Sunday 8 March 2009
4BC Brisbane - from 8.30am Monday 16 February 2009 until 5.00pm Sunday 8 March 2009
6PR Perth - from 8.30am Monday 16 February 2009 until 5.00pm Sunday 8 March 2009
The Promoter reserves the right to extend the competition period at its own discretion.
13. CHOOSING THE WINNERS
1 (one) winner for each market will be chosen at their respective radio station. 4 (four) winners in total will be chosen on Monday 9 March 2009 at 3pm local time in each state. The winners will be chosen based on correct entry method and the promoter's decision is final as to which kitchen they believe is the most deserving of the makeover. The winners will be contacted in due course as to how to redeem their prize.
Subject to State regulations, in the event that the Promoter becomes aware that the same person has
been selected as a prize winner more than once, the Promoter will cause another name to be
drawn/selected in their place.
In the event that the winners in each state of the major prize are unable to be contacted by Tuesday 10
March 5pm (AEST) 2009, or the prize winner is unable to accept the prize, the Promoters will conduct
a further draw at the same place as the original draw at 10am local time in each state on Wednesday 11
March 2009 in order to distribute the major prize, subject to any written directions given under any
applicable state legislation.
14. PRIZE DETAILS AND GRANITE TRANSFORMATIONS AUSTRALIA (GTA) CONDITIONS
Trend engineered stone component is for bench -top and splash backs only, prize will not exceed the equivalent of 4 slabs of Trend product.
Painting, plastering, tiling and other works resulting from the makeover of the kitchen structure remain the responsibility of the winner.
GTA will take full responsibility for rectification and/or payment of any damage to the winner's kitchen/property caused by GTA during the undertaking of the makeover.
Winner must make available their premises for check measurement no less than 6 weeks prior to the agreed date that makeover will take place.
GTA reserves the right to use all images of made over kitchen, before and after images for it's own promotional use without further permission from the winner.
Kitchen must be modular type to obtain full makeover. By modular GTA means that the carcass units of the kitchen have snap on hinges which allows for the units to have the door and draw fronts replaced.
Rates notice will be required as proof of property ownership by the prize winner.
If not a modular kitchen winner eligible for bench-top only makeover.
GTA will pay the average nominal amount to have services (gas & electricity) connected and reconnected to allow for the makeover to be completed (not more than $600) and has the right to use outside trades people of choice.
GTA will have makeover work completed by their nominated branch or company representative.
Any extra works required to ensure that the completed makeover meets all local regulations or that are changes to existing format will be met by the competition winner and paid direct to relevant trades, provided that they are first approved in writing by the competition winner prior to being incurred.
Sink will be Abey 1 & ¼ bowel sink from the basic range as will basic tap mixer.
Doors and panels may be chosen from the Polytec melamine range and be of square edge profile.
Granite Transformations will supply cook top, oven and basic exhaust fan as part of appliance package examples of which will be available for winner to view prior to installation. Should the winner decide to upgrade GTA is not required to pay any compensation in lieu of appliance set.
Should rectification work to existing substrate / bench-top be required prior to installation of Trend engineered stone surface it will be completed at the sole cost of the competition winner, provided that they are first approved in writing by the competition winner prior to being incurred.
The winner will choose from a range of handles as outlined by GTA, should the winner decide to purchase their own handles there will be no further compensation.

Any changes to original kitchen design / format must be paid for in full by prize winner prior to commencement of makeover work.
The winner's kitchen must be deemed as a safe workplace as outlined by OHS regulations at the time check measure is carried out, makeover is underway and at all times whilst GTA staff or their representatives are on site
Installation of Prize must be completed prior to 31 August 2009.
Approximate value: $12,000 per major prize including GST
